Family Echo – Terms of Use Agreement

Before using or signing in to Family Echo, please review the following terms. In order to avoid any misunderstandings, these terms are displayed in English only. If you would like to read these terms in your own language, please use a translation tool.

Family Echo is an Internet service ("Service") that allows individuals and families to build a family profile online. The Service is owned and operated by Familiality Ltd ("we", "our", "us" or "ourselves"), which is the controller of personal information processed by us through the Service. Privacy-related requests may be sent via the feedback form.

This Terms of Use Agreement ("Agreement") is a legally binding document outlining our policy for acceptable use of the Service, content posted on the Family Echo website, and your rights, obligations and restrictions in using the Service. By using the Service in any way, you agree to be bound by this Agreement, whether you have signed in or not. You are only authorized to use the Service if you agree to abide by all applicable laws and this Agreement. If you do not accept this Agreement, you should discontinue use of the Service immediately.

We may modify this Agreement at any time. Such a modification shall be effective immediately upon being posted to the Family Echo website, at the address https://www.familyecho.com/?page=terms or any other page which is linked from the Service. You agree to be bound by any changes in this Agreement when you use the Service after a modification is posted. We recommend you review this Agreement regularly to ensure you are aware of any changes.

  1. Use of the Service is void where prohibited. By using the Service, you represent and warrant that (a) all information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 14 years of age or older; and (d) your use of the Service does not violate any applicable law or regulation. If you are between 14 and 18 years of age, you represent and warrant that you have the legal consent of your parent or guardian to access the Service and agree to this Agreement.
  2. This Agreement shall remain in full force and effect while you use the Service. We may terminate your usage of the Service at any time, without warning or liability. Even after your usage is terminated, this Agreement remains in full effect.
  3. Upon signing in to the Service, you will be asked to choose a username and password (collectively, "Credentials"). You are entirely responsible for maintaining the confidentiality of these Credentials. You agree not to use the Credentials or account of any other party, to impersonate any other person in using the Service, or to disclose your Credentials to any third party. You agree not to transfer or sell your account. You agree to notify us immediately if you suspect any unauthorized use of your account or access to your Credentials. You are solely responsible for any and all use of your account.
  4. The Service is for the personal use of you and your family only and may not be used for any commercial purpose except as specifically approved by us. Illegal and/or unauthorized use of the Service, including collecting user details for the purposes of sending unsolicited email, is prohibited. Commercial advertisements and other forms of solicitation may be removed without notice or liability. You may not solicit Credentials or any personal information from other users for commercial or unlawful purposes.
  5. We do not claim any ownership rights in the names, genders, dates, relationships, places, contact details, biographical information, family links, text, files, photos or any other materials (collectively, "Content") that you post to the Service. After posting your Content to the Service, you retain all ownership rights in the Content, and you continue to have the right to use the Content in all ways permitted by law. By posting any Content to the Service, you hereby grant us a limited non-exclusive, fully-paid and royalty-free license to use and reproduce such Content through the Service for your use. In addition, you grant a limited non-exclusive, fully-paid and royalty-free license to invited members of your family to view, download, store, archive and back up this Content for personal purposes.
  6. Providing personal information to the Service is voluntary. If you choose not to provide certain information, some features may be unavailable or less useful, but you may still use the Service to the extent possible. We process personal information in order to provide, maintain, secure and improve the Service; enable you and invited family members to create, view, update, share, download and archive family information; manage accounts, sign-ins, invitations and user preferences; respond to requests, feedback and support inquiries; send occasional service, operational or promotional notifications relating to your account; prevent abuse, fraud, unauthorized access and unlawful activity; enforce this Agreement; comply with legal obligations or legal process; understand how visitors use the Service through analytics tools; and display, measure and improve advertisements shown on the Service. However, we will not use the Content that you post to the Service to create advertising profiles or to target personalized advertisements, although advertising partners may use technical and usage information as described below.
  7. We may access, use, preserve or disclose personal information where reasonably necessary to operate, support, secure or troubleshoot the Service; enforce this Agreement; prevent fraud, abuse or unlawful activity; respond to user requests; comply with law or legal process; or protect the rights, safety and property of users, Familiality Ltd or others.
  8. Notice and Takedown Procedure: Where required by applicable law, and subject to reasonable verification, you may request access to, correction, or removal of personal information about you that is processed by us through the Service via the feedback form. We may require information reasonably necessary to verify your identity, authority, and connection to the relevant family tree before responding to this request. We may decline a request where we cannot reasonably verify the requester, where the request would disclose personal information about another person, or where the request is excessive, abusive, unlawful or impractical. If family members disagree about whether particular personal information should appear in the Service, we may remove that information. Removed information may remain for a limited period in backups, logs or security records before being overwritten or permanently deleted. We may retain limited information where necessary for security, legal compliance, dispute resolution, abuse prevention or enforcement of this Agreement. Information accessed or downloaded by invited family members may remain outside our control.
  9. You represent and warrant that: (a) you own the Content posted by you to the Service or otherwise have the right to grant the license set forth above, (b) the posting of the Content does not violate the privacy rights, copyrights or any other rights of any person. You may not post or reproduce in any way any copyrighted material or other proprietary information belonging to other parties without obtaining the prior written consent of the owner of such rights. If you believe your work has been posted to the Service in a manner violating your rights, please contact us via the feedback form.
  10. You are responsible for ensuring that you have an appropriate basis to add, upload, share, or invite others to view personal information about living people. You should not add sensitive, private or intrusive information about a living person unless you have their permission or another lawful and appropriate basis to do so. If you are a living person whose information appears in a family tree, you may contact us via the feedback form to request removal.
  11. You must not upload personal information about a child unless you are the child's parent or guardian, have permission from the parent or guardian, or otherwise have an appropriate basis to do so. You must take particular care before uploading children's photos, contact details, addresses, schools, private notes, or other sensitive information. If you are the parent or guardian of a child who appears in a family tree without permission, you may contact us via the feedback form to request removal.
  12. You may not add any Content to the Service which is illegal, obscene, violent, sexual, lewd, hateful, harassing, racist, bigoted, demeaning, threatening, inciting, inflammatory, exploitative, defamatory, abusive, libelous, misleading or otherwise objectionable. We reserve the right to remove any such Content, according to our sole judgment, and bring it to the attention of relevant governmental or law enforcement authorities. If you believe any such content has been posted to the Service in a manner violating your rights, please contact us via the feedback form.
  13. We own and retain all rights in all materials provided by the Service, with the exception of Content posted by a user of the Service. These materials are protected by copyright, trademark, patent, trade secret and other laws. We hereby grant you a limited, revocable license to view these materials solely for your personal use in connection with using the Service. Some materials are provided to you as part of a download of your family information, and these materials may be stored, published, archived and backed up solely in accordance with the terms and conditions as documented by those materials.
  14. We assume no responsibility for monitoring the Content posted to the Service. If at any time we choose to monitor the Service for inappropriate Content, we nonetheless assume no responsibility for this Content and have no obligation to modify or remove inappropriate Content. You are solely responsible for the Content that you post to the Service. We make no warranties, express or implied, as to the accuracy or reliability of any Content in the Service. You may bring any problematic material to our attention via the feedback form.
  15. You may not interfere with, disrupt, or create an undue burden on any aspect or element of the Service, the equipment providing the Service, or any network related to the Service. It is explicitly forbidden to access the Service by any means other than ordinary access of the Family Echo website using a web browser. This restriction includes, but is not limited to, any automated script communicating with the Service. We reserve the right to block access to the Service from any IP address, IP address block, Internet Service Provider, individual, organization or country which is deemed, at our sole discretion, to be abusing the Service.
  16. The Service uses essential cookies in order to sign you in, and to remember some of your user preferences for using the Service. You may remove these cookies at any time by using the relevant option in your web browser.
  17. We may use third-party analytics tools to help us understand how visitors use the Service, improve the Service and measure the effectiveness of the Service. These tools may collect personal information such as pages visited, time spent on the site, browser and device information, IP addresses, approximate location derived from IP addresses and referring pages. These tools use cookies and similar technologies to collect and process this information. We will not share the Content that you post to the Service with third-party analytics tools.
  18. We may display advertisements provided by third-party partners on the Service. These partners may use cookies, pixels, IP addresses, browser and device identifiers or similar technologies to serve ads, measure ad performance, limit how often you see an ad, detect fraud and abuse, and personalize ads based on your visits to the Service and other websites. We take no responsibility for the content of these advertisements or the websites or other services they link to. You may bring any problematic advertisements to our attention via the feedback form. We will not share the Content that you post to the Service with third-party advertising partners.
  19. Personal information processed through the Service may be stored in the United States, the United Kingdom or the European Union. We use third-party service providers, including hosting, infrastructure, backup, email and security, to operate, maintain, secure and improve the Service. We use reasonable administrative, technical and organizational measures designed to protect personal information. However, no online service can guarantee absolute security.
  20. We are not responsible for any incorrect, inaccurate or outdated materials provided by the Service, whether caused by users of the Service or by any of the equipment or programming used to provide the Service. We are not responsible for the accuracy or opinions expressed on any website linked from the Service, whether this link was posted by a user or otherwise. We take no responsibility for third-party advertisements which are posted on the Service, or for goods or services provided by advertisers.
  21. We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications link failure, theft, destruction or unauthorized access to, or alteration of, any user information or communication. We are not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers, providers, equipment, software or email that occurs for any reason, or for any injury, death or damage to users or equipment resulting from use of the Service in any way. The Service is provided "AS-IS" and as available and we expressly disclaim any warranty of any kind. No advice or information obtained by you from us shall create any warranty not stated herein. The Service is not intended to act as a data backup service. You are solely responsible for keeping independent backup copies of all Content you post to the Service. We bear no responsibility or liability for the deletion, corruption, or loss of any Content.
  22. To the maximum extent permitted by applicable law, in no event shall we be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits arising from use of the Service, even if we have been advised of the possibility of such damages. We shall not be liable for any failure or delay in performance under this Agreement due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, military mobilization, riots, strikes, governmental action, internet service provider failures, or cyber-attacks. Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever will at all times be limited to the amount paid, if any, by you for the Service. Nothing in this Agreement excludes or limits any liability, right or remedy that cannot be excluded or limited under applicable law.
  23. Any dispute involving the Service shall be governed by the laws of the State of Israel, with exclusive jurisdiction in the courts of Tel Aviv, without regard to conflict of law provisions. You agree that any claim or cause of action arising out of or related to use of the Service or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred. You agree that any claims brought against us must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. In no event shall you seek or be entitled to rescission, injunctive, or other equitable relief, or to enjoin or restrain the operation of the Service.
  24. You agree to indemnify and hold Familiality Ltd, its subsidiaries, affiliates and their respective officers, agents, partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys' fees, made by any third party or regulatory authority due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above and/or if any Content you post to the Service causes us to be liable to another.
  25. This Agreement is accepted upon your use of the Service, and is further affirmed when you sign in to the Service. This Agreement constitutes the entire agreement between you and us regarding use of the Service. Our failure to exercise or enforce any right or provision of this Agreement shall not be construed as a waiver of such right or provision. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity or enforceability of any remaining provisions.
